1. Acceptance of Terms
By accessing or using the Avalon Inspired Learning (“AvalonIL”) website, platform, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not use the Service.
2. Definitions
- “Input” means all text, data, information, or content provided or uploaded by the User to the Service.
- “Output” means the text, data, course material, or other content generated or created by the AvalonIL AI models based on the User’s Input.
- “Content” refers collectively to both Input and Output, as well as any materials created or pasted by the User directly into the Service.
- “Avalon” refers to Avalon Inspired Learning, its affiliates, directors, officers, employees, and agents.
3. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to use AvalonIL. By using the Service, you represent and warrant that you meet these requirements.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
5. Permitted Use
You may use AvalonIL only for lawful purposes and in accordance with these Terms. You agree not to use the Service:
- In any way that violates applicable laws or regulations.
- To exploit, harm, or attempt to exploit or harm minors.
- To transmit any unsolicited or unauthorized advertising or promotional material.
- To impersonate or attempt to impersonate Avalon, an Avalon employee, another user, or any other person or entity.
6. Avalon Intellectual Property
All content, features, and functionality on AvalonIL (excluding User Content) are the exclusive property of Avalon and its licensors. This includes, but is not limited to, the underlying AI models, software code, proprietary data sets, and training methodologies.
You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.
7. User-Generated Content & AI Output
- 7.1 User Ownership: Users retain all right, title, and interest in all Input and Output. For the purpose of these Terms, the User is considered the Author and Sole Responsible Party for all Content, regardless of whether such Output is protectable by copyright law.
- 7.2 User Warranty: Avalon makes no representation or warranty regarding the copyrightability or non-infringement of any Output. Users warrant that they possess the necessary rights to the Input and that their use and publication of the Content will not infringe upon the intellectual property or proprietary rights of any third party.
- 7.3 License to Avalon: By using Avalon’s services, users grant Avalon a broad, perpetual, irrevocable, worldwide, royalty-free license to store, use, display, and process their Content as necessary to provide and support the services to which the user has subscribed.
- 7.4 No Training Right: This license does not include the right for Avalon to use user Content to train or improve its AI models.
- 7.5 Community Sharing: When users choose to share their course materials for superclasses or the user community, they retain ownership but grant Avalon, its partners, and subscribers the right to use, display, and edit those materials as needed for the enjoyment and delivery of the services.
8. User Responsibility and Liability
- 8.1 User Responsibility: Users are solely responsible for all Content they generate, submit, or share using Avalon’s services. Users are solely responsible for verifying the accuracy, completeness, and appropriateness of all Output before reliance or publication.
- 8.2 User Indemnification: The User agrees to defend, indemnify, and hold harmless Avalon, its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) the User’s Content, including any claim of copyright infringement, defamation, or violation of privacy; (b) the User’s breach of these Terms; or (c) the User’s gross negligence or willful misconduct.
- 8.3 Limitation of Liability: In all cases and uses, Avalon, its stakeholders, and partners accept zero liability for any harm, loss, or damages resulting from AI-generated content or any user-generated content.
- 8.4 Acceptance: Users must actively “Agree and Save” or “Agree and Submit” to these terms before using or saving AI-generated Content. The act of clicking these buttons constitutes explicit acceptance of these provisions.
9. AI Usage and Avalon Charges
- 9.1 Avalon Token System: AI usage on the platform is measured in "Avalons," where 1 Avalon equals 1,000 AI tokens. Each subscription tier includes a specific allocation of Avalons as outlined in the pricing page.
- 9.2 Subscription Limits: Users are provided with monthly or annual Avalon allocations based on their subscription tier:
- Starter: 0 Avalons (pay-as-you-go only)
- Student: 0 Avalons (usage billed to teacher)
- Homeschool: 20,000 Avalons/year
- Academy: 10,000 Avalons/month or 25,000 Avalons/year
- Pro: 20,000 Avalons/month or 40,000 Avalons/year
- 9.3 Overage Charges: When users exceed their included Avalon allocation, additional usage is automatically billed at:
- $4.99 per 1,000 Avalons, or
- $34.99 per 10,000 Avalons (30% savings)
- 9.4 Student AI Usage: AI usage by students enrolled in a teacher's classes is billed to the teacher's account, including any overage charges that may result.
- 9.5 Minicourse Author Responsibility: Course authors who create and publish minicourses (also known as "Avalon Packages" or "SCORM packages") are solely responsible for all Avalon charges incurred by users who access AI features within those courses. This includes, but is not limited to:
- AI-powered study buddy features
- AI grading and feedback
- AI-generated hints or assistance
- Any other AI functionality embedded in the course
- 9.6 Monitoring Usage: Users are responsible for monitoring their Avalon usage through the account dashboard and managing their consumption to avoid unexpected charges.
- 9.7 Billing: Overage charges are processed automatically through the user's payment method on file with Stripe, our payment processor.
10. Superclass and Community Collaboration
When two or more teachers form a superclass, this constitutes a quasi-contractual agreement and relationship between those teachers. Avalon's role is limited to providing the supporting technology and platform; Avalon is not a party to any agreement or arrangement between users.
11. Curriculum Mapping and Community Intelligence
- 11.1 Curriculum Data Collection: Avalon collects data about your curriculum choices, standards alignment (CCSS, NGSS, state standards), module topics, pacing, and teaching sequences to provide curriculum mapping, compliance reporting, and gap analysis features.
- 11.2 Community Intelligence (Opt-In): With your explicit consent via Account Settings, your anonymized curriculum data contributes to community insights such as "What topics are popular this fall in 4th grade math?" or "Which teaching approaches show highest success rates?" Your identity is never revealed—data is linked only to a hashed user ID.
- 11.3 Opting Out: You may opt out of community intelligence features at any time. Opting out stops future data contribution but does not delete previously contributed anonymized data from aggregated statistics.
- 11.4 Individual Privacy: Your individual curriculum plans, lesson content, and personal teaching materials remain private and are never shared without your explicit action (e.g., via Superclass sharing).
12. Institutional Database Integration (Academy/Enterprise Tiers)
- 12.1 Optional Integration: Schools and institutions may optionally integrate Avalon with their Student Information Systems (SIS) such as PowerSchool, Jenzabar, Infinite Campus, or other databases.
- 12.2 Institutional Agreement: Database integration requires explicit agreement between Avalon and the institution. Individual teachers and homeschool users are not affected by institutional integrations.
- 12.3 Data Shared: Integration may include student enrollment data, roster information, and grade passback to the institution's database via secure API connections (OneRoster, LTI 1.3, or custom APIs).
- 12.4 Institution Responsibility: The institution is responsible for compliance with FERPA, COPPA, and other applicable education privacy laws regarding student data.
- 12.5 Premium Service: Database integration is available as a premium add-on service for Academy and Enterprise tier customers and is not included in Homeschool or Starter tiers.
13. Teacher Marketplace & Professional Networking
13.1 Academy Tier Structure: Avalon offers three tiers for educators:
- Free Educator Tier ($0): Create a professional marketplace profile with limited features—link to external photos/videos (no uploads), use preview windows for linked content, participate in teacher-institution matching, create basic portfolio with external links, and connect with potential employers. Free tier profiles are publicly visible with limited detail.
- Academy Monthly ($99.99/month): Full marketplace features including photo/video uploads, enhanced profile visibility to institutions, unlimited messaging with matches, interview scheduling, access to $300 worth of professional development courses with LinkedIn-verified certificates, portfolio management, and priority placement in matching algorithm.
- Academy Annual ($799.99/year): Same features as monthly Academy with approximately 33% savings.
13.2 Professional Development Courses: Paid Academy subscriptions include $300 worth of PD courses:
- "Using AI in the Classroom: Best Practices" ($150 value, 10 hours)
- "Differentiation Strategies for Diverse Learners" ($100 value, 8 hours)
- "Data-Driven Instruction Fundamentals" ($50 value, 5 hours)
- Each course completion earns a LinkedIn-verified badge and downloadable certificate.
- Free Educator tier does not include PD course access.
13.3 Teacher-Institution Matching:
- Teachers create marketplace profiles showcasing credentials, experience, teaching philosophy, subject expertise, and availability.
- Educational institutions browse teacher profiles and use Avalon's AI-powered matching algorithm (Gemini-based compatibility scoring) to find qualified candidates.
- Matching uses a "swipe" interface—both parties must express interest to unlock messaging.
- Once matched, teachers and institutions can message, schedule interviews, and negotiate employment terms.
13.4 Institution Contact Credits:
- Institutions can browse teacher profiles for free (limited information for free tier profiles, full details for paid Academy profiles).
- To unlock full contact details and messaging for a specific teacher, institutions purchase contact credits at $10 per teacher contact.
- Contact credits are non-refundable and expire after 12 months if unused.
- Institutions are solely responsible for hiring decisions, employment verification, background checks, and compliance with labor laws.
13.5 Booking & Scheduling:
- Matched teachers and institutions can schedule interviews, trial sessions, or contract discussions through Avalon's booking system.
- Calendar integration, timezone support, and automated reminders are provided.
- Video meeting links may be generated (integration pending).
- Users are responsible for attending scheduled appointments. Repeated no-shows may result in reduced matching priority.
13.6 Profile Accuracy & Verification:
- Teachers warrant that all information in their marketplace profile is accurate, current, and truthful.
- False credentials, misrepresentation of experience, or fraudulent information may result in immediate profile removal and account termination.
- Background checks and credential verification are the responsibility of hiring institutions.
- Avalon does not verify, endorse, or guarantee the accuracy of teacher credentials or qualifications.
13.7 Teacher-Institution Relationships:
- Avalon is a platform facilitating connections only. We are not a party to any employment agreement, contract, or relationship between teachers and institutions.
- All employment terms, compensation, benefits, and working conditions are negotiated directly between teachers and institutions.
- Disputes between teachers and institutions must be resolved independently. Avalon is not liable for employment disputes, contract breaches, or workplace issues.
13.8 Subscription Terms:
- Academy subscriptions renew automatically at the selected billing interval (monthly or annual).
- Users may cancel subscriptions at any time. Cancellation takes effect at the end of the current billing period.
- No refunds are provided for partial billing periods.
- Upon cancellation, paid features (photo/video uploads, PD courses, enhanced visibility) are downgraded to free Educator tier features.
- Profile data is retained but converted to free tier limitations (external links only).
14. Teacher Services Marketplace
14.1 Service Offerings: Teachers may create and publish service listings for tutoring, grading, curriculum review, lesson planning, consultations, parent coaching, and other educational services.
14.2 Service Categories: Available categories include but are not limited to:
- Subject tutoring (math, science, English, history, languages, test prep, special needs)
- Grading services (assignments, essays)
- Professional services (curriculum review, lesson planning, consultation, special education consultation, parent coaching)
- Custom services as approved by Avalon
14.3 Pricing & Fees:
- Teachers set their own pricing (hourly, fixed, or per-unit rates).
- Avalon charges a 15% platform fee on all service transactions.
- Teachers receive 85% of the service price via Stripe Connect payouts.
- Platform fees are automatically deducted before teacher payout.
14.4 Stripe Connect Requirements:
- Teachers must create a Stripe Connect Express account to receive service payouts.
- Stripe collects bank account details, tax identification, and identity verification documents per financial regulations.
- Teachers are responsible for tax reporting and compliance with self-employment tax laws.
- Payouts are processed according to Stripe's standard payout schedule (typically 2-7 business days).
14.5 Service Delivery & Quality:
- Teachers are solely responsible for delivering services as described in their listings.
- Services must be delivered professionally, on time, and in accordance with the service description.
- Teachers warrant they possess the necessary qualifications, credentials, and expertise to provide the advertised services.
14.6 Customer Reviews & Ratings:
- Customers may leave 5-star ratings and written reviews after service completion.
- Reviews are publicly displayed on service listings.
- Reviews must be honest and based on actual service experience. False or malicious reviews may be removed.
- Teachers cannot remove negative reviews but may respond publicly to address concerns.
14.7 Refunds & Disputes:
- Service refunds are handled on a case-by-case basis.
- Customers should contact the teacher directly to resolve service issues.
- If resolution cannot be reached, customers may contact Avalon support for mediation.
- Avalon reserves the right to issue refunds in cases of fraud, non-delivery, or severe quality issues.
- Refunded transactions incur no platform fee.
14.8 Service Suspension:
- Avalon may suspend or remove service listings that violate these terms, are fraudulent, or receive repeated quality complaints.
- Teachers may be banned from offering services for egregious violations.
14.9 No Subscription Required for Buyers:
- Homeschool families and customers can purchase services directly without an Avalon subscription.
- Service purchases are one-time transactions processed through Stripe.
15. Data Privacy, Security, and Best Practices
Avalon pledges its best efforts to maintain and follow industry best practices in data services, security, privacy, and safety for the benefit and protection of Avalon and all subscribers. While Avalon strives to protect user data and ensure service suitability, no system is infallible, and users are encouraged to exercise caution and good judgment in all uses of the platform. 16. Third-Party Services
Avalon may use third-party services, such as Google for authentication or AI model providers. These services have their own privacy policies, and we encourage you to review them. Avalon does not share your personally identifiable information (PII) with these services beyond what is necessary for their function.
Stripe Payment Processing: We use Stripe for payment processing (subscriptions, contact credits, service purchases) and Stripe Connect for teacher service payouts. By using payment features, you agree to Stripe's Terms of Service and Privacy Policy.
17. Disclaimers
Marketplace Disclaimers:
- Avalon does not verify teacher credentials, qualifications, or background checks. Hiring institutions are solely responsible for verification.
- Avalon does not guarantee service quality, job placement, or hiring outcomes.
- Teacher-institution employment relationships are independent of Avalon. We are not liable for employment disputes, contract breaches, workplace safety, or labor law violations.
- Service quality, delivery, and customer satisfaction are the sole responsibility of the service provider (teacher).

19. Changes to Terms
Avalon reserves the right to update or modify these Terms of Use at any time. Users will be notified of material changes and continued use of the service constitutes acceptance of the updated terms.

17. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.
